NATIONAL REFORM THE PRESIDENT: LEGISLATIVE SUPPORT OF THE MAZHILIS

Astana, May 6, the House of the Mazhilis. Today, there was the plenary session of the Mazhilis under the chairmanship of Kabibulla Dzhakupov.

Anticipating the discussion of the agenda, the Chairman of the Majilis emphasized the importance of a new stage of state and social development for Kazakhstan.

 Kabibulla Dzhakupov reminded of the establishment of the National Commission on Modernization, the main task of which is the management of the phased implementation of the five institutional reforms of the President of Kazakhstan. As noted by the Speaker of the Mazhilis, a number of members from the House are delegated to participate in its work. Kabibulla Dzhakupov urged all the deputies to promptly work on the legislative support of the whole package of measures to modernize the country.

– After the President’s approval of the Commission’s proposals for the implementation of the five institutional reforms, the operational legislative maintenance of the entire package of measures to modernize the country is imposed upon the Parliament. It is expected that a set of laws in draft will be submitted to the Mazhilis for consideration. As the President said, “Since the great reforms, we are paving the way for the “Everlasting Nation”. In turn, we have to justify the trust of our President to the deputy corps, and honorably fulfill all tasks assigned to us, - said the Chairman of the Mazhilis.

At the plenary session the deputies of the House at the second reading approved the draft of the Code of Civil Procedure with associated amendments.

The CCP draft is aimed at ensuring the effective remedies of constitutional rights and freedoms of individuals and legal entities by modernization of the civil procedural legislation to enhance its efficiency, the active use of conciliatory procedures in the proceedings and also ensuring the use of information technology tools in the courts’ work.

In particular, it provides for the introduction of a new way of reconciliation with the lawyers’ participation - Participatory process that provides an opportunity for participants to negotiate the dispute with the active participation of lawyers. New Chapter “Simplified (written) proceedings” involves the consideration of cases within a month on the basis of written evidence without the need for an oral hearing. A distinctive feature of the CCP draft is the introduction of the special composition of the court to protect the rights of investors. Consequential amendments on the improvement of civil procedural law amend the Act of the Republic of Kazakhstan “On Advocacy”, “On Notarial System”.

The Chamber has got the go-ahead for the law in draft on ratification of the Agreement on cooperation in the field of prevention and emergency management in the Caspian Sea.

The agreement regulates the cooperation of Azerbaijan, Iran, Kazakhstan, Russia and Turkmenistan in the event of emergency situations of natural and technogenic character in the Caspian Sea.

The mazhilismen also approved the law in draft on the ratification of the amendments to the Kazakh-Russian intergovernmental agreement on establishment of the space rocket complex “Baiterek” at the cosmodrome “Baikonur”.

Along with this the Mazhilis deputies started the work in the new laws in draft. They are ratification instruments: Agreement between Kazakhstan and Turkmenistan on delimitation of the Caspian Sea; on the activities of border representatives (border commissioners); and the Agreement on Cooperation of engineering troops of the armed forces of CIS member states in the field of humanitarian demining. In the same series there is the Agreement between Kazakhstan and the United States on mutual legal assistance in criminal matters.

Also the Mazhilismen will work on the draft of legislative innovations concerning counteraction to legalization (laundering) of proceeds from crime and the terrorist financing.

The President of the Republic of Kazakhstan awarded a number of deputies of the Mazhilis for the significant contribution to the social harmony strengthening in the country, for ensuring the unity of the people of Kazakhstan, as well as to commemorate the 20^th anniversary of the Assembly of the National of Kazakhstan with the Jubilee Medal “Kazakhstan halky Assembly 20 years”. At the plenary session the Chairman of the Chamber Kabibulla Dzhakupov handed the awards over to. The mazhilismen are awarded with Certificate of Merit from the CIS IPA Council for active assistance in organizing and holding of the action of the Inter-parliamentary Assembly of CIS members-states “Memory Race”.  And the Minister of Culture and Sports of Kazakhstan Arystanbek Muhamediuly is awarded with the order “Commonwealth” for active participation in the activities of the Inter-Parliamentary Assembly and its bodies, for contribution into the friendship strengthening between the peoples of the CIS members-states.
